Welcome to Lux Residential Services ("we," "our," "us," or "Company"). These Terms of Service ("Terms") govern your use of our home services, website, and all related services.

By booking our home services, using our website, or engaging with our company, you ("Customer," "you," or "your") agree to be bound by these Terms. If you do not agree to these Terms, please do not use our home services.

2. Services Provided
2.1 Home Services Overview

Lux Residential Services provides comprehensive property maintenance and home services throughout Coral, Florida and Southwest Florida, including but not limited to:

  • Pool & Spa Services - Weekly maintenance, chemical balancing, equipment repair, green pool recovery

  • Lawn Care & Landscaping - Mowing, edging, palm tree trimming, irrigation repair, tropical landscaping

  • House Cleaning Services - Deep cleaning, rental turnovers, regular maintenance cleaning

  • Pressure Washing - Driveways, patios, exterior walls, roof cleaning, pool decks

  • Handyman Services - Minor repairs, fixture installation, painting, drywall work

  • Hurricane Preparation & Recovery - Property securing, storm monitoring, debris removal, emergency repairs

  • Pest Control Services - Termite treatment, mosquito prevention, roach control, rodent exclusion

  • HVAC Maintenance & Repair - Tune-ups, filter replacement, emergency AC repair, duct cleaning

  • Gutter Cleaning & Repair - Debris removal, downspout clearing, gutter guard installation

  • Holiday Lighting Installation - Christmas light design, installation, maintenance, and removal

2.2 Service Packages

We offer bundled home services packages (Essential Care, Premium Care, Luxury Estate) and à la carte services. Package details, inclusions, and terms are outlined in your service agreement.

2.3 Service Area

Our home services are available in Coral, Cape Coral, Fort Myers, Bonita Springs, Naples, and surrounding Southwest Florida communities within a 30-mile radius. Service availability may vary by location.

3. Booking and Scheduling
3.1 Service Requests

You may request home services by:

  • Quotes for home services are estimates and may be adjusted based on actual property conditions

  • Quotes are valid for 30 days from the date provided

  • Final pricing for home services will be confirmed before work begins

3.3 Scheduling
  • Home services appointments are scheduled based on availability

  • We will provide a service window (e.g., 8 AM - 12 PM)

  • For recurring home services, we will establish a regular schedule

  • Changes to scheduled home services must be made at least 24 hours in advance

3.4 Access to Property
  • You must provide safe and reasonable access to your property for home services

  • If access is provided via lockbox, gate code, or key, you authorize our entry

  • You are responsible for securing pets during home services visits

  • You must disclose any hazards or special conditions affecting home services delivery

4. Pricing and Payment
4.1 Pricing
  • Prices for home services are provided in writing (quote, proposal, or service agreement)

  • Pricing may vary based on property size, condition, and specific home services required

  • We reserve the right to adjust pricing with 30 days' notice for recurring home services

4.2 Payment Terms
  • One-Time Services: Payment due upon completion of home services

  • Recurring Services: Monthly billing for ongoing home services packages

  • Accepted Payment Methods: Credit cards, debit cards, checks, ACH transfers

  • Late Payments: A late fee of $25 or 1.5% per month (whichever is greater) applies to overdue home services invoices

4.3 Additional Charges
  • Extra work beyond the original home services scope requires authorization

  • Emergency home services may incur additional fees

  • Travel fees may apply outside our standard service area

  • After-hours home services are subject to premium rates

4.4 Refunds and Credits
  • Refunds for prepaid home services are issued if we cannot perform scheduled work

  • Service credits may be issued for quality issues with home services

  • Refunds are processed within 7-10 business days

5. Cancellations and Rescheduling
5.1 Customer Cancellations
  • 24+ Hours Notice: No cancellation fee for home services

  • Less Than 24 Hours: 50% cancellation fee may apply

  • No-Show/No Access: Full service fee charged if we cannot access property for scheduled home services

5.2 Company Cancellations
  • We may cancel or reschedule home services due to:

    • Severe weather conditions

    • Equipment failure

    • Staff emergencies

    • Unsafe property conditions

  • You will be notified as soon as possible and rescheduled at no additional cost

5.3 Recurring Service Cancellations
  • Monthly home services packages require 30 days' written notice for cancellation

  • Early termination fees may apply if canceling before minimum contract period

  • Final invoice for completed home services is due upon cancellation

6. Service Quality and Guarantees
6.1 Quality Commitment

We are committed to providing high-quality home services. If you are not satisfied with our work:

  • Contact us within 48 hours of completed home services

  • We will return to address the issue at no additional charge

  • Our goal is 100% satisfaction with all home services

6.2 Warranty
  • Workmanship warranty: 30 days on completed home services

  • Parts and materials: Manufacturer's warranty applies

  • Warranty does not cover damage from misuse, neglect, or subsequent modifications

6.3 Limitations

Our home services guarantee does not cover:

  • Pre-existing conditions not disclosed

  • Damage from events beyond our control (storms, floods, etc.)

  • Normal wear and tear after home services completion

  • Customer-caused issues after our home services visit

7. Liability and Insurance
7.1 Our Insurance

Lux Residential Services maintains:

  • General liability insurance

  • Workers' compensation insurance

  • Professional liability coverage

This protects both parties during home services delivery.

7.2 Limitation of Liability

To the maximum extent permitted by law:

  • Our liability for home services is limited to the amount paid for the specific service

  • We are not liable for indirect, incidental, or consequential damages

  • We are not responsible for pre-existing conditions discovered during home services

  • We are not liable for damage to items not disclosed prior to home services

7.3 Your Responsibilities

You are responsible for:

  • Damage to our equipment caused by undisclosed hazards

  • Injuries to our staff from unsafe property conditions

  • Securing valuables during home services visits

  • Disclosure of all relevant property conditions affecting home services

8. Property Damage
8.1 Our Responsibility

If our home services team damages your property:

  • Notify us immediately

  • We will inspect the damage

  • We will repair or compensate for verified damage caused by our home services

  • Claims must be made within 48 hours of completed home services

8.2 Pre-Existing Conditions

We are not responsible for:

  • Damage to items in poor condition prior to home services

  • Failure of systems at end of life during routine home services

  • Discovery of existing problems during home services delivery

8.3 Claims Process

To file a property damage claim related to home services:

  3. We will investigate and respond within 5 business days

  4. Resolution through repair, replacement, or insurance claim

9. Weather and Force Majeure
9.1 Weather-Related Delays

Home services may be delayed or canceled due to:

  • Equipment limitations in adverse weather

You will not be charged for weather-canceled home services, and we will reschedule at the earliest opportunity.

9.2 Force Majeure

We are not liable for delays or inability to perform home services due to:

  • Government actions or restrictions

  • Pandemics or public health emergencies

  • Utility failures

  • Other events beyond our reasonable control

10. Customer Conduct
10.1 Respectful Interaction

You agree to:

  • Treat our home services team with respect and professionalism

  • Provide accurate information for home services delivery

  • Comply with reasonable requests from our staff

  • Maintain a safe environment for home services work

10.2 Prohibited Conduct

You may not:

  • Harass, threaten, or abuse our home services staff

All content related to our home services (website, marketing materials, designs, logos) is owned by Lux Residential Services and protected by intellectual property laws.

11.2 Testimonials and Photos

By providing testimonials or allowing us to photograph your property after home services:

  • You grant us permission to use these materials for marketing

  • We may feature your property (anonymously) in promotional content

  • You may request removal of your content at any time

12. Privacy and Data

Your personal information collected through our home services is governed by our Privacy Policy. By using our home services, you consent to our data practices as described in the Privacy Policy.

13. Dispute Resolution
13.1 Informal Resolution

If you have a dispute regarding our home services:

14. Governing Law

These Terms and all home services provided are governed by the laws of the State of Florida, without regard to conflict of law principles. Any legal action related to our home services must be brought in Lee County, Florida.

These Terms, together with your service agreement and our Privacy Policy, constitute the entire agreement between you and Lux Residential Services regarding home services.
